Terms of Service

Effective date: March 2026. Governed by the laws of Delaware, United States.

These Terms of Service (“Terms”) govern your access to and use of the Atlas e-signature API and related services provided by Hostfi Inc. (dba Atlas) (“Atlas”, “we”, “us”). By creating an account or making an API call, you agree to these Terms. If you do not agree, do not use the service.

1. Description of service

Atlas is an e-signature API. We provide infrastructure for sending documents to signers, collecting legally binding electronic signatures, and returning signed documents with a cryptographic audit trail. Atlas is a technology service, not a law firm. Nothing we provide constitutes legal advice. If you need legal advice about whether a particular agreement is enforceable in your jurisdiction, consult a licensed attorney.

2. Account registration and API keys

You must create an account to use Atlas. You agree to provide accurate information during registration and keep it current.

Your API keys authenticate requests to the Atlas API. You are responsible for keeping your keys secure. Do not share keys in public repositories, client-side code, or anywhere they could be exposed to unauthorized parties. If a key is compromised, revoke it immediately from the dashboard.

All activity that occurs under your API key is your responsibility, whether or not you authorized it.

3. Acceptable use

You may use Atlas only for lawful purposes. You agree not to:

  • Send fraudulent documents or forge signatures
  • Impersonate another person or organization in a signing request
  • Send documents that contain illegal content or facilitate illegal activity
  • Use Atlas to send unsolicited commercial communications (spam)
  • Reverse-engineer, scrape, or attempt to extract Atlas infrastructure beyond what the documented API provides
  • Attempt to circumvent rate limits, quotas, or security controls
  • Resell or sublicense access to the Atlas API without our written permission

4. AI-assisted field detection

The Atlas smart send feature uses AI to detect and classify fields in uploaded PDF and DOCX documents. Field detection is probabilistic. We do not guarantee that every field will be detected or that detected fields will always be classified correctly. Before sending a document, you should review the detected fields and verify they match your intent. Atlas is not liable for errors, omissions, or misclassifications produced by the field detection system.

5. Legal validity of signatures

Electronic signatures collected through Atlas are intended to be legally binding under the Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001) and the Uniform Electronic Transactions Act (UETA), provided that all applicable consent requirements are met.

Legal enforceability depends on the underlying agreement, the jurisdiction, and the circumstances of the signing. Atlas provides the infrastructure for collecting signatures and maintaining audit trails. We make no warranty that any specific agreement signed through Atlas will be enforceable in any particular legal proceeding.

Atlas is not a party to the agreements you send. We are not liable for disputes between you and signers about the validity, interpretation, or enforceability of any agreement.

6. Rate limits and quotas

Your use of the Atlas API is subject to rate limits. Current limits are published in the documentation. We may update limits at any time. If your usage consistently exceeds your plan limits, we may throttle requests or contact you to discuss your requirements. Accounts that repeatedly exceed limits without resolution may be suspended.

7. Data and privacy

Your use of data collected through Atlas is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Atlas, you agree to the data practices described there.

8. Prohibited uses

In addition to the acceptable use requirements above, you specifically may not use Atlas to:

  • Send documents on behalf of a person or organization you do not have authority to represent
  • Manufacture false evidence of a transaction
  • Collect signatures on documents you know the signer has not agreed to review
  • Operate a competing e-signature service using Atlas infrastructure

We reserve the right to investigate suspected violations and to cooperate with law enforcement where required.

9. Termination

You may close your account at any time by contacting us at support@atlaswork.ai. On closure, your API keys are revoked and your account data is scheduled for deletion per our Privacy Policy. Signed envelope records may be retained for up to 7 years to meet legal recordkeeping requirements.

We may suspend or terminate your account if you violate these Terms. We will give you notice where practical, but we may act immediately if necessary to prevent harm. Termination for cause does not entitle you to a refund of any amounts paid.

10. Limitation of liability

To the maximum extent permitted by applicable law, Atlas is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of Atlas is capped at the amounts you paid to Atlas in the twelve months preceding the event giving rise to the claim. If you have not paid Atlas anything in that period, our liability is capped at $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Atlas and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Atlas service, your violation of these Terms, or your violation of any third-party rights in connection with documents you send through Atlas.

12. Disclaimers

The Atlas service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of Atlas will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

14. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email at least 30 days before the new Terms take effect. Continued use of Atlas after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to updated Terms, close your account before the effective date.
